On Wednesday, Sept. 8, 2010 at
7:00 p.m., the Lake County Planning Board will hold a public hearing in
the large conference room of the Lake County Courthouse on the following
items:

FLATHEAD LAKE RESORT
MAJOR
CONDOMINIUM SUBDIVISION
Barbara M. Sanders has proposed
a major subdivision to convert an existing multi-use resort property into
condominium ownership to allow 12 existing motel units in multiple
buildings to be converted to 7 residential units under condominium
ownership, and an existing building containing a single-family residence
and a restaurant & bar to be converted to two respective units under
condominium ownership. The condominium units would be served by the
property’s current public wastewater treatment system and public water
system, which obtains water from Flathead Lake. The application includes
access related variance requests to allow private roads to not comply
with the standards outlined by the applicable Lake County Subdivision
Regulations. The subject property is located within the East Shore Zoning
District. The tract is ±1.48-acres in size, is located at 24377 Montana
Highway 35, and is legally described as Tract A of COS 5192, located
within a portion of Gov’t Lot 3 of Section 4 of T24N, R19W.
FLATHEAD LAND DEVELOPMENT COMPANY,
LLC VARIANCE REQUESTS
WILD HORSE RANCH SUBDIVISION
Flathead Land Development Company, LLC is requesting a variance to the
applicable Lake County Subdivision Regulations and amendments to
preliminary and final plat conditions for the 13- residential lot Wild
Horse Ranch major subdivision. The Board of Lake County Commissioners
granted preliminary plat approval for the subdivision as “Rollins Heights
Subdivision” in September of 2005. Final plat approval of the subdivision
as “Wild Horse Ranch” subdivision was then granted in July of 2009, with
a Subdivision Improvements Agreement entered into between the developer
and Lake County for infrastructure improvements as required by the
preliminary plat approval. The preliminary plat approval required the
internal road to be constructed with a 26-foot wide, chip-sealed surface
in compliance with the effective subdivision regulations, and the final
plat approval and Subdivision Improvements Agreement adopted this
standard. The developer’s current variance and amendment requests are to
allow the roads to be constructed with substandard 20-foot wide paved
surfaces. The Wild Horse Ranch subdivision is located in the N ½ of
Section 21, T25N, R20W, and is located along the NW side of US Hwy 93
across from the highway intersection with Zelezny Road.

in the large conference room of the Lake County Courthouse on the
following item:

VARIANCE REQUEST
Laurie Schuman is requesting a
variance to the setback requirements of the Upper West Shore Zoning
District Regulations. The applicant has received county approval to
relocate a portion of Rollins Lakeshore Drive and dedicate a new 40 foot
wide right-of-way easement to Lake County for the new road. The
applicant is requesting a variance to allow the public road setback to be
determined from the new driving surface instead of the new right-of-way.
The public road setback will be used to determine conformance with zoning
regulations for future structure locations and impervious surface area
standards. The 1.91 acre property is located at 21959 Rollins Lakeshore
Drive and is legally described as Lot 13A of Crescent Beach Lots, located
within Section 29 of T25N, R20W, and located within Subdistrict B – Lower
Lakeside of the Upper West Shore Zoning District.
The complete application and plans may
be viewed at the Lake County Planning Dept, Room 315, of the Lake County
Courthouse. The Board of Adjustment encourages the public to attend this
meeting and voice comments they may have on the proposal. The Planning
Dept will accept written comments on the proposal to be included in the
information packets sent to the Board of Adjustment. This comment must be

PUBLIC HEARING NOTICE
On Tuesday, September 14, 2010
at 6:00 p.m., the Polson City-County Planning Board will hold a public
hearing in the Polson City Hall Council Chambers on the following items:
WIRELESS COMMUNICATION FACILITY PERMIT APPLICATION
SBA Network Services, Inc on
behalf of the ITT Corporation, 12930 Worldgate Dr, Suite 400, Herndon,
VA, 20170, has submitted a permit application for a Federal Aviation
Administration (FAA) wireless communication facility to be located at
2220 JB Drive within the Low Density Residential Zoning District (LRZD)
of the Polson City-County Planning Area of the Polson Development Code (PDC).
The facilities would consist of a 47-foot monopole tower and associated
equipment on property owned by Donald L. and Karen E. Claffey, which
contains similar facilities. The parcel is 0.927-acres in size and is
legally described as Deed Exhibit H-1953 less tracts on COS 2717, COS
3322, and COS 3489, located in the W ½ SE ¼ of Section 10, Township 22
North, Range 20 West. The City-County Planning Board will hold a public
hearing and make a recommendation to the Board of Lake County
Commissioners on this proposal within 60 days of this public hearing.
The County Commissioners are scheduled to review this proposal at
10:00am on October 20, 2010.
STONE
RIDGE DEVELOPMENT, LLC VARIANCE/AMENDMENT REQUEST
STONE RIDGE RANCH PHASE ONE
SUBDIVISION AND VERGERONT RANCH SUBDIVISION ‘PHASE II’
Stone Ridge Development, LLC, of PO Box 1600, Polson, MT, is requesting
a road related variance to the applicable Lake County Subdivision
Regulations, amendments to preliminary and final plat conditions, and
application and Environmental Assessment amendments for the Stone Ridge
Ranch, Phase One and Vergeront Ranch, Phase II residential subdivisions.
The final plats have been filed, with Subdivision Improvements
Agreements entered into between the developer and Lake County for
infrastructure improvements as required by the subdivision approvals.
The plat approvals required a road now known as Glacier Creek Drive to
be constructed with a 26-foot wide, chip-sealed surface. Glacier Creek
Drive is partially constructed and connects the subdivisions’ road
network to Tower Road. The developer’s current requests are to allow
Glacier Creek Drive to be constructed with a substandard 13-foot wide
gravel surface, and be gated but allow for emergency access, which
places the subdivisions out of compliance with the subdivision
regulations’ requirement that primary access roads must not exceed a
1500-foot maximum length if the roads serve more than 15-lots. The
subdivisions are located approximately one mile northwest of Polson in
Sections 31 and 32 of Township 23 North, Range 20 West, and are commonly
referred to as “Stonehorse”. Vergeront Ranch, Phase II is located
within the Rural Residential Zoning District (RRZD) of the Polson
Development Code’s City-County Planning Area, and Stone Ridge Ranch,
Phase One is located within the Stone Ridge Estates Zoning District.

the large conference room of the Lake County Courthouse on the following

LAKESHORE
PROTECTION REGULATIONS DRAFT UPDATES
The Planning Board will hold an
informal work session as part of the process to update the Lake County
Lakeshore Protection Regulations. The Planning Board will meet to
continue reviewing draft sections of the regulations. Once complete,
draft sections will be incorporated into a final draft of the
regulations. A final draft will be reviewed at a formal public hearing
to be held sometime after October 2010. The current Lakeshore
Protection Regulations and draft sections may be viewed online at
www.lakecounty-mt.org/planning/lakeshore.html or at the Lake County
Planning Dept. The Planning Board encourages the public to attend this
meeting and participate in the process.
